Independent Contractor Determination Form

Description:

The purpose of the Independent Contractor Determination Form is to avoid being scrutinized by the IRS for not having a true independent contractor relationship.  In this regard, to avoid liability, a review of the proposed work to be done by any individual or entity is required by the company before a contractual arrangement may be entered into.  The questions on this review are as follows:

• Describe the specific work assignment(s) or task(s) this individual will provide and the length of time expected to complete each assignment or task.
• How long do you anticipate this individual’s assignment will last?
• Describe when and how often the individual's services will be used.
• Describe the amount of discretion this individual has over the performance of work for the company.
